In previous years, the lack of New York online sportsbook options kept the handle and revenue numbers down as other states, like Colorado sportsbooks, throughout the US saw tremendous growth.

However, faced with an increasing budget deficit, the movement to offer online sports betting picked up some serious momentum in 2021, and now it’s finally possible for someone in New York to place a bet online without having to go to a neighboring NJ online sportsbook.

With the retail betting locations hours away from New York City, most bettors were not willing to travel that far. Instead, these bettors went across the border to New Jersey, where online betting is available. Now that mobile wagering is finally from within NY borders, this lost tax revenue will stay in the state where it will benefit its residents.

The allowance of NY online sports betting is a huge boost to the state. It took long a long time for the passing of legal online sports betting, but at last it came in early 2022.

NY Sports Betting Rules

The two major restrictions in New York are:

  • Betting on NY college teams or events in the state is not allowed
  • Betting is limited to sporting events

Current New York sports betting rules are pretty clear for both retail and online betting. There are just two major restrictions which are highlighted above. Sportsbooks here do have plenty of freedom when choosing available betting markets, with all of the top professional sports in the US being offered. 

There are also international betting markets available in NY sports betting, but these options vary by sportsbooks. Each book will choose what sports or leagues to feature, but there is a long list available to them.

Several states in the US have limitations when it comes to collegiate sporting events, and NY is no different. This does hurt the betting market as NY has some popular local college sports teams.

Betting on esports is also illegal in New York as it is not deemed a sporting event. This restriction also applies to betting on awards shows such as the Grammys or Oscars. 

NY Sports Betting Regulations

NY sports betting actually dates all the way back to 2013 when voters in the state passed a referendum to expand gambling in the state. Sportsbooks were included in that referendum, but the state has to wait for the federal ban on sports betting to be lifted, which didn’t happen until 2018. 

The New York State Gaming Commission approved sports wagering rules and regulations in January 2019 even though legislation was not signed. There were some attempts during that year to allow for online sports betting as well, but those bills died out quickly.

Senator Joseph Addabbo has long been the state’s leading proponent of legalization, and introduced several bills to regulate online sports betting. He had trouble getting the bills out of the state Senate until 2021 when there was finally a breakthrough due to the state’s revenues significantly decreasing due to COVID. In spring 2021, the state budget that included language to legalize sports betting was passed by the legislature and signed into law by Governor Cuomo.

Governor Andrew Cuomo was originally an opponent of NY online sports betting, claiming that a constitutional amendment was needed to add that form of betting. Cuomo changed his stance and became a supporter of legal online sportsbooks in the state.

NY Online Betting Gets Passed

After the state budget was signed into law in spring 2021, state regulators got to work developing rules and guidelines for regulated online sports wagering, including setting a tax rate at an unheard of 51 percent. At the end of 2021, after accepting applications from sportsbooks wanting to do business in the state, nine sportsbook operators were selected to offer online sports betting through mobile betting apps.

This list included a consortium of FanDuel, DraftKings, BetMGM, and Bally Bet. Another group of operators is made up of Caesars, Wynn Interactive, Resorts, PointsBet, and Rush Street Interactive.

The third group of operators that did not get access to the licenses consisted of Fanatics, Penn National’s Barstool Sportsbook, and celebrity music mogul Jay-Z.

The holy grail-moment for the Empire State came in early 2022 when the first 4 out of 9 total mobile wagering platforms became downloadable for people in NY. Online sports betting was finally legal in New York! Since then bettors have flocked to the sportsbook apps, quickly making New York the state with the most revenue generated from sports wagering.
